Terms of Use

These Terms of Use govern your access to and use of PMPracticeLab.com and the products, subscriptions, content, and services provided by Brainless Robot LLC, the operator of PM Practice Lab.

By creating an account, purchasing a subscription, or otherwise using PM Practice Lab, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the service.

1. Acceptance of these Terms

These Terms form a legally binding agreement between you and Brainless Robot LLC concerning your use of PM Practice Lab.

If you use the service on behalf of a company, school, or other organization, you represent that you have authority to bind that organization to these Terms. In that case, “you” includes both you and the organization.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use PM Practice Lab.

By using the service, you represent that you satisfy these requirements and that your use of the service is not prohibited by applicable law.

3. Educational purpose

PM Practice Lab provides independent educational and certification-examination preparation materials. PM Practice Lab is not a certification body, accredited educational institution, or official examination provider.

Practice questions, explanations, scores, readiness indicators, study recommendations, and other materials are provided for educational purposes only.

We do not guarantee:

  • Eligibility to sit for any certification examination.
  • A passing score on any certification examination.
  • Certification, employment, promotion, compensation, or career advancement.
  • That practice questions will match questions appearing on an actual examination.
  • That all certification requirements, policies, or examination outlines will remain unchanged.

You are responsible for confirming current eligibility requirements, examination policies, application procedures, fees, and content outlines directly with the applicable certification organization.

4. Accounts

Certain features require an account. You agree to provide accurate, complete, and current information when creating and maintaining your account.

You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • Using a secure password and taking reasonable steps to protect your account.
  • All activity that occurs through your account.
  • Promptly notifying us if you suspect unauthorized access or misuse.

Accounts and subscriptions are personal and may not be shared, transferred, sublicensed, rented, sold, or made available to another person.

We may apply reasonable technical restrictions relating to simultaneous sessions, excessive device changes, unusual login activity, automated access, or other indications of account sharing or misuse.

5. Subscriptions and automatic renewal

PM Practice Lab may offer monthly, annual, or other recurring subscription plans. The price, billing frequency, included features, and applicable taxes will be disclosed before you complete your purchase.

Automatic renewal

Unless otherwise disclosed at checkout, paid subscriptions automatically renew at the end of each billing period until cancelled.

By purchasing an automatically renewing subscription, you authorize Brainless Robot LLC and its payment processor to charge the applicable subscription fees and taxes to your selected payment method on each renewal date.

Trials and promotional offers

A free trial or promotional period may automatically convert to a paid subscription unless cancelled before the end of the stated trial or promotional period.

Eligibility requirements, duration, pricing, and other conditions for a trial or promotion will be disclosed when the offer is presented.

Price changes

We may change subscription prices in the future. Any price change will apply prospectively and will be communicated as required by applicable law.

Payment authorization

You agree to provide valid and current payment information. If a payment cannot be completed, we may retry the payment, restrict access to paid features, or suspend the subscription until the amount due is paid.

Paddle as our authorized reseller

Our order process is conducted by our online reseller and Merchant of Record, Paddle.com. Paddle acts as the authorized reseller of PM Practice Lab subscriptions and one-time access products, and is the Merchant of Record for all orders placed through our checkout.

Paddle processes payments, billing, tax collection, invoicing, subscription management, and returns on behalf of Brainless Robot LLC. By completing a purchase, you authorize Paddle to charge your selected payment method and to handle payment-related transactions according to Paddle’s terms and privacy practices.

For customer service inquiries, billing questions, refund requests, or disputes related to payments, Paddle provides customer service and handles returns. You may also contact us at ey@brainlessrobot.com and we will direct you to the appropriate Paddle support channel if needed.

6. Cancellation and refunds

Cancelling a subscription

You may cancel your subscription at any time using the cancellation method made available through your account or the payment platform used to complete your purchase.

You may also contact ey@brainlessrobot.com for assistance locating the applicable cancellation method.

Cancellation prevents future renewal charges. Unless otherwise stated, you will continue to have access to paid features through the end of the subscription period already paid for.

Deleting your account or ceasing to use the service does not necessarily cancel an active subscription. You must complete the applicable cancellation process.

Refund requests

Cancelling a subscription does not automatically issue a refund. To request a refund, email ey@brainlessrobot.com from the email address associated with your account.

Refund eligibility is governed by the refund terms disclosed at checkout and any Refund and Cancellation Policy posted by PM Practice Lab.

Except where required by law or expressly approved by us, subscription payments are nonrefundable, and we do not provide credits or prorated refunds for partially used subscription periods.

Billing errors

Confirmed duplicate charges and other verified billing errors will be corrected or refunded as appropriate. Approved refunds will generally be returned to the original payment method.

7. Acceptable use

PM Practice Lab may be used only for lawful, personal, noncommercial examination preparation unless we provide written permission for another use.

You may not:

  • Share, publish, sell, sublicense, distribute, or commercially exploit platform content.
  • Copy, photograph, record, reproduce, or systematically save substantial portions of the question bank.
  • Scrape, crawl, index, harvest, download, or extract content through automated or manual bulk methods.
  • Use bots, scripts, browser automation, artificial-intelligence agents, or similar tools to access or reproduce platform content without written permission.
  • Use PM Practice Lab content to create, train, evaluate, or improve a competing question bank, course, website, application, model, or commercial product.
  • Circumvent subscriptions, paywalls, usage limits, access controls, security systems, or technical protections.
  • Share your account or permit another person to use your subscription.
  • Reverse engineer, decompile, interfere with, overload, damage, or disrupt the service.
  • Attempt to gain unauthorized access to accounts, systems, networks, databases, or source code.
  • Upload malware, malicious code, or content intended to interfere with the service.
  • Impersonate another person or organization.
  • Submit false, misleading, fraudulent, or unauthorized information.
  • Use the service in a manner that violates intellectual-property, confidentiality, privacy, contractual, or other legal rights.
  • Use the service for unlawful, fraudulent, abusive, harassing, or harmful activity.
  • Upload, request, reconstruct, disclose, or distribute actual certification-examination content.

8. Exam content and integrity policy

Users, contributors, contractors, and administrators may not upload, reconstruct, disclose, request, solicit, purchase, sell, exchange, or distribute content encountered on an actual certification examination.

Prohibited examination content includes actual or substantially reconstructed:

  • Questions and answer choices.
  • Scenarios and case studies.
  • Images, charts, calculations, exhibits, or simulations.
  • Correct answers or claimed correct answers.
  • Notes, recordings, photographs, screenshots, or memorized content.
  • Descriptions detailed enough to reproduce confidential examination material.

You may not ask another person to recall, reproduce, verify, or provide actual examination content.

Content submitted to PM Practice Lab must be original, properly licensed, or based on lawfully available public educational sources. It must not be derived from confidential, recalled, memorized, photographed, recorded, purchased, or reconstructed examination material.

We may remove suspected examination content, restrict or terminate accounts, preserve relevant records, and take other reasonable actions to protect examination integrity and our legal rights.

Suspected examination-content violations may be reported to ey@brainlessrobot.com.

9. Intellectual property

PM Practice Lab and its original questions, explanations, software, source code, interfaces, designs, graphics, databases, scoring systems, branding, and other content are owned by or licensed to Brainless Robot LLC and are protected by applicable intellectual-property laws.

Subject to these Terms, we grant you a limited, personal, revocable, nonexclusive, nontransferable, and nonsublicensable license to access and use PM Practice Lab for your individual, noncommercial study purposes.

No ownership interest is transferred to you. All rights not expressly granted in these Terms are reserved.

10. User submissions and feedback

You retain ownership of original content you submit to PM Practice Lab, subject to the license described below.

By submitting feedback, corrections, suggestions, questions, explanations, comments, or other content, you grant Brainless Robot LLC a worldwide, nonexclusive, royalty-free, transferable, and sublicensable license to:

  • Host, store, reproduce, and review the submitted content.
  • Modify, adapt, format, and combine the content with other materials.
  • Use the content to operate, maintain, develop, and improve PM Practice Lab.
  • Use anonymized or aggregated feedback for research, quality control, and product development.

You represent that you have the rights necessary to submit the content and that it does not contain confidential examination material or violate another party’s rights.

11. Service availability and changes

We may add, remove, update, reorganize, suspend, or discontinue questions, explanations, features, plans, categories, scoring methods, or other portions of the service.

We do not guarantee that a particular number of questions, feature, subject category, examination format, or platform function will remain available indefinitely.

We may temporarily interrupt access for maintenance, updates, security work, technical problems, or circumstances outside our reasonable control.

12. Suspension and termination

We may restrict, suspend, or terminate your account or access to paid or free features when we reasonably believe that:

  • You violated these Terms or another applicable policy.
  • Your account is being shared, sold, transferred, or misused.
  • You scraped, copied, distributed, or commercially exploited platform content.
  • You submitted, requested, or distributed prohibited examination content.
  • Your activity creates a security, legal, operational, or reputational risk.
  • You engaged in fraud, abuse, harassment, or unlawful conduct.
  • Required subscription fees remain unpaid.

Where reasonably appropriate, we may provide notice and an opportunity to correct the violation. We are not required to provide advance notice when immediate action is reasonably necessary to protect users, systems, content, examination integrity, or legal rights.

You may stop using PM Practice Lab at any time. Provisions that by their nature should survive termination will remain effective, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and disputes.

13. Third-party services

PM Practice Lab may rely on or link to third-party services, including payment processors, hosting providers, authentication providers, analytics tools, and external educational resources.

We do not control and are not responsible for the availability, security, accuracy, content, policies, or practices of unrelated third-party services.

Your use of a third-party service may be governed by separate terms and privacy policies provided by that third party.

Payment processing by Paddle

Payments for PM Practice Lab are processed by Paddle.com, which acts as our authorized reseller and Merchant of Record. Paddle handles payment processing, billing, tax, invoicing, subscription management, refunds, and related customer service on our behalf.

Paddle’s services are subject to Paddle’s Buyer Terms and Privacy Policy. Paddle’s name will appear on your payment method statement for PM Practice Lab purchases.

14. Disclaimer of warranties

To the maximum extent permitted by law, PM Practice Lab is provided “as is” and “as available.”

Brainless Robot LLC disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, quiet enjoyment, title, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, completely secure, or that every question, explanation, score, readiness indicator, or recommendation will be complete, accurate, or current.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.

15. Limitation of liability

To the maximum extent permitted by law, Brainless Robot LLC and its owners, affiliates, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

This exclusion includes lost profits, lost data, lost opportunities, lost employment, examination fees, preparation expenses, business interruption, or failure to obtain a certification or other desired result.

To the maximum extent permitted by law, our total liability arising from or relating to PM Practice Lab will not exceed the greater of:

  1. The amount you paid to Brainless Robot LLC for PM Practice Lab during the 12 months before the event giving rise to the claim; or
  2. One hundred United States dollars.

Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, these limitations apply only to the maximum extent permitted by law.

16. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Brainless Robot LLC and its owners, affiliates, employees, contractors, licensors, and service providers from claims, losses, liabilities, damages, judgments, and reasonable expenses arising from:

  • Your unlawful or unauthorized use of PM Practice Lab.
  • Your violation of these Terms.
  • Your violation of another party’s intellectual-property, privacy, confidentiality, contractual, or other rights.
  • Content you submit to the service.
  • Your submission, solicitation, reconstruction, or distribution of prohibited examination content.

17. Informal dispute resolution

Before filing a formal legal claim, you and Brainless Robot LLC agree to make a reasonable good-faith effort to resolve the dispute informally for at least 30 days.

A written dispute notice should include:

  • Your full name and the email address associated with your account.
  • A description of the dispute and relevant facts.
  • The specific resolution you are requesting.
  • Relevant receipts, screenshots, communications, or other supporting documentation.

This informal-resolution requirement does not prevent either party from seeking urgent injunctive relief or bringing an eligible claim in small-claims court.

18. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Subject to legal rights that cannot be waived, judicial proceedings arising from or relating to these Terms or PM Practice Lab must be brought in a state or federal court with jurisdiction over Brainless Robot LLC’s principal place of business in California.

Nothing in these Terms limits consumer protections, legal remedies, or venue rights that cannot lawfully be waived.

19. Changes to these Terms

We may update these Terms periodically to reflect changes to our services, business practices, pricing, technologies, or legal obligations.

The updated Terms will be posted on this page with a revised “Last updated” date. We will provide additional notice of material changes when required by applicable law.

Your continued use of PM Practice Lab after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.

20. Severability and waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

An unenforceable provision will be modified only to the minimum extent necessary to make it enforceable while preserving its original purpose where possible.

A failure to enforce a provision of these Terms is not a waiver of the right to enforce it later.

21. Entire agreement

These Terms, the Privacy Policy, any Refund and Cancellation Policy, and any additional terms displayed at checkout constitute the agreement between you and Brainless Robot LLC concerning PM Practice Lab.

These Terms supersede prior or contemporaneous communications and agreements concerning the same subject matter.

22. Independence and trademark disclaimer

PM Practice Lab is an independent examination-preparation service. It is not affiliated with, endorsed by, sponsored by, authorized by, or approved by Project Management Institute, Inc.

PMP® and PMI® are registered marks of Project Management Institute, Inc. All third-party trademarks, certification names, and service marks belong to their respective owners.

References to third-party certifications and trademarks are used solely for identification and descriptive purposes and do not indicate affiliation, sponsorship, endorsement, or approval.
